EMPLOYMENT DISCRIMINATION ATTORNEY

The most common form of discrimination happens in the workplace.   Sexual harassment is a type of discrimination, where the employer is responsible for creating or allowing a “hostile work environment.” There are civil rights laws against discrimination in any facet of employment, it can be discrimination during the hiring and firing process, but it can also happen during the course of your employment.   When you suspect that you are being treated unfairly at work, a call to a New York City Employment Discrimination Attorney will shed light on your rights.

An employer may not discriminate based on the following criteria:

  • Age (Over 40)
  • Gender
  • Race
  • Ethnicity
  • Skin Color
  • National Origin
  • Mental or Physical Disability
  • Genetic Information
  • Relationship to someone who may be discriminated against
  • Pregnancy or Parenthood

Some examples are:

  • Specifying the above criteria in a job advertisement (Examples: Waitress, Able Bodied, Young Lady, Strong Man, Youthful)
  • Excluding potential employees during the recruitment process (Example: Only men were interviewed for a position, even though many women applied.)
  • Denying some staff compensation or benefits (Example: The younger employees are given all the overtime.)
  • Paying equally-qualified workers, with the same job description and experience, different salaries (Example: The German employees are paid more than the Dutch employees.)
  • Discriminating when assigning disability leavematernity leave, or retirement options (Example: An older worker is given less disability leave, in the hope they will retire.)
  • Denying or disrupting the use of company facilities (Example: There are not enough restrooms for women and they have to wait in line.)
  • Discrimination when issuing promotions or lay-offs (Example: The French workers are always getting promoted, whereas the British workers are not.)

Sexual Harassment and the Hostile Work Environment

A hostile work environment is an environment that is difficult or uncomfortable for another person to work in due to discrimination.   The most common type is sexual harassment which might include fondling, suggestive remarks, sexually-suggestive photos displayed in the workplace, use of sexual language, or off-color jokes.   If a co-worker makes an offensive joke once, you report it to your employer, the employer speaks to the co-worker and it never happens again – that is NOT harassment or a hostile work environment.  Your employer did that they were supposed to do and succeeded in properly protecting you.  If there is an ongoing pattern of harassment, it’s time to call a New York City Employment Discrimination Attorney.

From Wikipedia:

To be unlawful, the conduct must create a work environment that would be intimidatinghostile, or offensive to a reasonable person. An employer can be held liable for failing to prevent these workplace conditions, unless it can prove that it attempted to prevent the harassment and that the employee failed to take advantage of existing harassment counter-measures or tools provided by the employer.

A hostile work environment may also be created when management acts in a manner designed to make an employee quit in retaliation for some action. For example, if an employee reported safety violations at work, was injured, attempted to join a union, or reported regulatory violations by management, and management’s response was to harass and pressure the employee to quit. Employers have tried to force employees to quit by imposing unwarranted discipline, reducing hours, cutting wages, or transferring the complaining employee to a distant work location.

The United States Supreme Court stated in Oncale v. Sundowner Offshore Services, Inc.[4] that Title VII is “not a general civility code.” Thus, federal law does not prohibit simple teasing, offhand comments, or isolated incidents that are not extremely serious. Rather, the conduct must be so objectively offensive as to alter the conditions of the individual’s employment. The conditions of employment are altered only if the harassment culminates in a tangible employment action or is sufficiently severe or pervasive.

Why Do Lawyers Always Want to Bring Lawsuits in the Bronx?

According to the New York Post, The Bronx is the "lawsuit capital of NYC."  The Bronx is the second smallest borough, yet more lawsuits are filed there due to the belief that Bronx juries are more generous to plaintiffs than any other borough.  The statistics are clear that the highest verdicts in the State are brought in by Bronx juries.  That's why Personal Injury Attorneys always want to bring a lawsuit in the Bronx, whenever possible.  Councilman Andrew Cohen (D Bronx) says, “Any way they can figure out to find a nexus to bring a case in The Bronx, they’re going to do that,” he said. “Bronx people are generally poorer than in other parts of the city, [...]

Psychological Injuries Lawsuits

Some psychological injuries are so severe that they can be as disabling as serious physical injuries.  When a careless or reckless act caused intense trauma, special arrangements must be made when pursuing a lawsuit.  This concept originated with “collaborative divorce,” where a psychologist becomes part of the team so that settlement discussions can stay on track.  With lawsuits that involved extremely traumatic events, this formula can also be applied, and a lawsuit for psychological injuries can be brought. Of course, any accident is traumatic.  Fearing for your life when you are hit by a car or slipping on water and breaking your leg are “traumatic events,”, but these accidents do not shatter the core of your [...]

The Psychological Impact of Bullying

Gone are the days when bullying was considered a “rite of passage” and parents whose children have been bullied are told things like “teach them to stand up for themselves” and that “boys will boys.”  We know now that bullying has serious has a serious lifelong impact on a child, and that it has been linked to the current rash of school shootings. While laws on the books are being strengthened, the enforcement of those laws is lagging behind.  It’s time to hold schools accountable for the harm due to the psychological impact of bullying o their students. According to National Voices for Equality, Education and Enlightenment (NVEEE)“Every 7 MINUTES a child is bullied. Adult [...]

THE PRISON INDUSTRIAL COMPLEX AND IT’S IMPACT ON CHILDREN

Prison conditions in the United States have the lowest standards compared to other highly developed countries, and the neglect and abuse in the for-profit prisons is worst of all.  Most alarming is the situation at Juvenile Detention Centers, where children as young as twelve years old are held.  Thankfully, there are inmate abuse and neglect attorneys bringing cases for these children throughout the country. In 2013, The Huffington Post , in the article “Prisoners for Profit”:reported: In 2001, an 18-year-old committed to a Texas boot camp operated by one of Slattery’s previous companies, Correctional Services Corp., came down with pneumonia and pleaded to see a doctor as he struggled to breathe. Guards accused the teen of faking [...]

10 Defensive Driving Tips

These 10 defensive driving tips will help you avoid accidents.  We are all taught these 10 defensive driving tips when we take driver's education classes, but as the years go by, it's easy to forget! 1. DON'T EXPECT OTHER DRIVERS TO FOLLOW THE RULES OF THE ROAD Just because you stop at stop signs and don't go through red lights, other drivers may not be so careful.  They might even be drunk, texting, sleepy or distracted.  When you are at an intersection, even if you have the right of way, check carefully to see if any cars are coming.  Make sure to look carefully for pedestrians that might be jaywalking, especially children.  Do not expect [...]

When Should I Call a Civil Rights Attorney?

I get calls all the time with people asking me to represent them for violations of their Civil Rights.  Their neighbors are blasting loud music.  They have been fired from their job.  Their co-op is trying to evict them because their children are noisy.  Their neighbor is yelling racial epithets at them.  There is so much misunderstanding about what a Civil Rights Attorney can and can't do for them, that I want to take some time to explain. Lawsuits are expensive, and a Civil Rights Attorney will handle your case on a contingency retainer, but it must be an "actionable" case under the law where is it possible to collect money damages.  This means that there [...]
