The law takes into consideration all the facts and circumstances when assigning fault for an accident.  Children in traffic accidents do not have the same laws applied as for traffic accidents involving adults.  Drivers have a much higher duty of care when they should be aware that children may be playing on the streets or walking to school.  Even if a child comes running out into the street to retrieve a ball in a residential area, the driver is still at fault if he hits the child because he should have been driving slow enough and carefully enough under the circumstances.  This is also true near schools, especially at times of the day when children should be expected to be walking to or from school.
