INADEQUATE SECURITY ATTORNEY

The duty of care is “fact-driven,” meaning that it depends very much on the particular type of property, nature of its use and its location.  For example, a business that serves alcohol such as a bar, nightclub or casino, is expected to employ a security staff.  One of the most common actions handled by an inadequate security attorney is a bar/nightclub assault.  When a person is assaulted either by an over-eager bouncer or by another patron, these establishments can be held liable.  A shoe store would not be expected to provide as much security and is not serving alcohol, so a claim against a store because another customer punched you, would not be successful, as this is not something reasonable to anticipate.

Crime demographics play a part in this analysis.  An apartment building in a high crime area might be expected to have substantial security measures in place, whereas a vacation condo in the countryside would not.  Another factor is where on the property the accident happened.  Somebody assaulted in a back alley would not have as strong a claim as somebody attacked in the lobby.
